Pumicestone Passage Pirates Inc. – Boat, Trailer and Outboard Raffle Terms & Conditions

1. Promoter Details

The raffle is conducted to assist in funding mental health and wellbeing initiatives, including working toward funding psychologists within the Moreton Bay and Sunshine Coast regions, alongside broader community initiatives associated with #piratesofftheplank.

2. Eligibility

  • Entry is open only to persons aged 18 years or older.
  • By purchasing a ticket, entrants warrant they are legally permitted to participate.
  • Participation constitutes acceptance of these Terms and Conditions.
  • Tickets are available to Australian residents where lawful.

3. Raffle Details

Prize Description

The major prize consists of:

  • 3.0 metre Bass Boat;
  • 1992 Mercury 9.9HP Electric Start Outboard;
  • registered trailer with new springs;
  • Lowrance Hook 2 Fish Finder;
  • navigation lights; and
  • rod holders.

Approximate total prize value: AUD $2,500.

The boat is owned by Pumicestone Passage Pirates Inc.

The vessel is currently registered and described by the Promoter as roadworthy and ready to fish.

Registration transfer is included.

The vessel will be wrapped by Pumicestone Passage Pirates Inc. with wrapping works to be completed by Aragon Wraps on Bribie Island.

Safety equipment is not included.

The prize is awarded strictly “as is”. No warranty, guarantee, refund, exchange, maintenance support, seaworthiness guarantee, mechanical warranty, or ongoing representation is provided by the Promoter.

The winner is solely responsible for:

  • ongoing registration;
  • insurance;
  • transport;
  • inspections;
  • maintenance;
  • operational safety;
  • licensing requirements; and
  • compliance with all Queensland maritime and transport laws.

4. Ticket Sales

  • Tickets are AUD $20 each.
  • A maximum of 500 tickets will be sold.

  • Tickets are non-refundable except where required by law.
  • The Promoter reserves the right to refuse or cancel any entry where reasonably necessary.

5. Draw Details

  • There will be one (1) major prize winner only.
  • The raffle will be drawn immediately upon all tickets selling out, or on 29 August 2026, whichever occurs first.
  • If all tickets sell prior to the final draw date, the draw may be livestreamed publicly.
  • If tickets are not sold out prior, the draw will occur publicly at the Promoter’s fishing competition event on 29 August 2026 at approximately 1:00pm Queensland time.
  • The draw will be publicly witnessed.
  • The winning ticket will be selected randomly.

6. Winner Notification and Redraw

  • The winner will be contacted using the contact details supplied during ticket purchase.
  • The winner’s name may be published on the Promoter’s website and social media platforms.
  • If the winner cannot be contacted, or fails to claim the prize within a reasonable timeframe determined by the Promoter, a redraw may occur within seven (7) days.
  • Any redraw will occur under the same conditions as the original draw.

7. Privacy and Media Consent

By entering the raffle, entrants consent to the Promoter:

  • collecting personal information for raffle administration purposes;
  • contacting entrants regarding the raffle;
  • publishing the winner’s name and promotional photographs where reasonably necessary; and
  • using winner-related promotional content in connection with the raffle and future fundraising activities.

Personal information will be handled in accordance with applicable Australian privacy laws.

8. Limitation of Liability

To the maximum extent permitted by law:

  • the Promoter excludes all liability arising from participation in the raffle;
  • the Promoter makes no representation regarding the mechanical condition or future performance of the prize;
  • entrants release the Promoter, its management committee, volunteers, sponsors, ambassadors, affiliates, contractors, and associated entities from any loss, damage, injury, claim, cost, or liability associated with the raffle or use of the prize.

The Promoter accepts no responsibility for:

  • technical failures;
  • interrupted online sales;
  • lost or delayed communications;
  • payment processing issues;
  • incorrect entrant details; or
  • circumstances beyond its reasonable control.

9. Compliance with Queensland Law

This raffle is intended to be conducted in accordance with the Charitable and Non-Profit Gaming Act 1999 (Qld) and associated Queensland legislation.

Based on the advertised maximum ticket sales of 500 tickets at AUD $20 each, the maximum gross proceeds are AUD $10,000.

This amount presently falls below the Queensland Category 3 gaming licence threshold of AUD $50,000 gross proceeds. (business.qld.gov.au)

However, the Promoter acknowledges that additional obligations may still apply to charitable gaming, fundraising conduct, advertising, and record keeping under Queensland law. (legislation.qld.gov.au)

The Promoter reserves the right to amend these Terms and Conditions where necessary to ensure ongoing legal compliance.

10. Cancellation or Amendment

The Promoter reserves the right to cancel, postpone, suspend, or amend the raffle where necessary due to unforeseen circumstances, technical issues, legal requirements, safety concerns, or circumstances beyond the Promoter’s reasonable control.

Any changes will be published through official Promoter communication channels.

11. Responsible Fundraising Statement

Pumicestone Passage Pirates Inc. conducts fundraising activities to support community outcomes and mental health initiatives across the Moreton Bay and Sunshine Coast regions.

The organisation promotes responsible fundraising practices and reserves the right to disqualify any entrant engaging in fraudulent, unlawful, abusive, or improper conduct.

12. Acceptance of Terms

Participation in the raffle constitutes full acceptance of these Terms and Conditions.
